Terms and Conditions

Welcome to CaloriQ.

These Terms of Use (“Terms”) govern your access to and use of the CaloriQ mobile application, website, and associated services (collectively, the “Services”). By creating an account, accessing, or using any part of the CaloriQ Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Services.

1. What CaloriQ Does

CaloriQ is a nutrition intelligence platform powered by proprietary AI. Our app uses video and voice inputs to deliver precise macronutrient and micronutrient insights based on the food you consume. We help users build nutritional awareness and healthier habits, but we do not provide medical advice (see Section 6).

2. Who May Use CaloriQ

You must be at least 13 years old (or the minimum age in your country that allows you to consent to data processing) to use CaloriQ. If you are under 18, you must have permission from a parent or legal guardian.

  1. By using CaloriQ, you represent and warrant that:
    • You have the legal capacity to enter into these Terms
    • You will provide accurate, complete information in your account
    • You will not share your login credentials with others

3. Your Account and Responsibilities

You are responsible for maintaining the confidentiality of your account and any activity that occurs under it.

  1. You agree not to:
    • Use the Services in any unlawful or unauthorized way
    • Copy, modify, distribute, sell, or license any part of the Services without our written permission
    • Reverse engineer or attempt to extract source code from the app
    • Upload false, misleading, or harmful information

We reserve the right to suspend or terminate your account if you violate these Terms.

4. Intellectual Property

All content and technology within CaloriQ — including our proprietary AI, user interface, analytics models, and all branding elements — are owned by CaloriQ and protected by intellectual property laws.

You may not use, reproduce, or distribute any part of the Services without express written consent from CaloriQ.

5. Paid Services and Subscriptions

  1. CaloriQ may offer paid features, subscription plans, or limited-time trials. By purchasing a subscription, you agree to:
    • Pay all applicable fees
    • Provide valid payment information
    • Understand that subscriptions may auto-renew unless cancelled before the renewal date

All fees are non-refundable unless otherwise stated. You may cancel your subscription at any time via your app store settings or through the in-app account page.

6. No Medical Advice

CaloriQ is designed to support general nutrition awareness and is not a medical device.

We do not diagnose, treat, or prevent any disease. Information provided in the app is not medical advice and should not be relied upon as such. Always consult a qualified healthcare provider before making dietary or medical decisions.

7. Privacy

We take your privacy seriously. Please review our Privacy Policy to understand how your data is collected, used, and protected. CaloriQ is committed to handling sensitive health data in compliance with HIPAA and other applicable laws where required.

8. Modifications and Updates

We may update the Services, including content and features, at any time. We may also update these Terms. If material changes are made, we’ll notify you via email or through the app. Continued use after changes means you accept the revised Terms..

9. Disclaimer of Warranties

  1. The Services are provided on an “as-is” and “as-available” basis. We make no warranties or
    guarantees about:
    • Accuracy of nutritional estimates
    • Fitness for a particular purpose
    • That the app will be error-free or uninterrupted

You use CaloriQ at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, CaloriQ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim is limited to the amount you paid for the Services in the prior 12 months.

11. Termination

We reserve the right to terminate or suspend your access to the Services at any time for violations of these Terms or suspected misconduct.

You may delete your account at any time via the app settings.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of- law principles.

Any dispute shall be resolved through binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association. You agree to waive any right to class actions.
